The Contentious-Administrative Chamber of the Superior Court of Justice of the Valencian Community (TSJCV) has annulled several sections of an article of the Mobility Ordinance of the Valencia City Council that imposed limitations on the commercial activity of VTCs (transport vehicles with driver) such as Uber or Cabify, as reported in a statement.

The obligation that VTC vehicles must be contracted at least one hour before the service is provided, the prohibition of parking at airports, shopping centers and other places of great concentration and generation of demand for transport services and the prohibition of of attracting customers through geolocation.

The Fourth Chamber has considered appeals against said rule presented by some companies in the sector and the National Commission for Markets and Competition (CNMC) and has annulled various sections of article 53 bis of the Mobility Ordinance.

The magistrates apply their own jurisprudence in both resolutions (it was already ruled in the same terms in relation to a municipal ordinance of Elx), as well as that established in this regard in February 2023 by the Supreme Court
