The Spanish Agency for Data Protection (AEPD) has ex officio initiated prior investigation actions against the American company OpenAI, owner of the ChatGPT service, for a possible breach of the regulations.

In a statement, the AEPD explained that last week it requested the European Data Protection Committee (EDPB) –of which the AEPD is a part along with other data protection authorities– that ChatGPT be included in the service ChatGPT as a topic to address in your plenary meeting.

The AEPD considers that global treatments that can have a significant impact on the rights of individuals require harmonized and coordinated actions at the European level in application of the General Data Protection Regulation.

The committee decided in the plenary held today to launch a working group (‘task force’, in English) to promote cooperation and exchange information on the actions carried out by the data protection authorities.

With the initiation of the investigation in Spain and the participation in the European working group, the AEPD acts in parallel “within the framework of its powers and competences as a national supervisory and control authority, as well as in coordination with its European counterparts through of the committee.”

The AEPD defended “the development and implementation of innovative technologies such as artificial intelligence with full respect for current legislation” considering that “only from this starting point can a technological development compatible with rights and freedoms be carried out of people”.
