A juvenile court has released under supervision with precautionary measures the only minor who was in custody accused of participating in the alleged sexual assault of an 11-year-old girl at the Màgic shopping center in Badalona (Barcelonès Nord).

As explained by sources from the Superior Court of Justice of Catalonia (TSJC) this Thursday, the court has decided to release him after an appearance on April 11 with all the parties, after the defense of the minor requested to end the internment .

As a precautionary measure, the court has imposed a ban on the minor to communicate with and approach the victim within 500 meters, as well as to go to the shopping center where the events supposedly took place.

The girl’s family, which has reacted with astonishment to the judicial decision, filed a complaint last December for sexual assault, after which the Mossos d’Esquadra minors unit opened an investigation, for which until the So far, five of the alleged perpetrators have been identified, two of them arrested. Of the two detainees, one was the minor who was in custody to date, while the other was on supervised release from the beginning.

The other three young people accused of participating in the sexual assault were under 14 years of age, so the case was referred to the General Directorate for Child and Adolescent Care (DGAIA), to the department of inimputable minors.

Freedom responds to a request from the defendant’s lawyer, after the judge does not consider that there is a risk of flight or recidivism, despite the fact that the attacker has a history of similar events.

On the other hand, the young man who threatened to kill the victim’s brother for having reported the case, is still detained in a detention center.
