Since the creation of the LaLiga Integrity and Security Department (2015/16) there have been 13 racist incidents in La Liga matches. All cases have been investigated and reported to the Prosecutor’s Office by the employer. Among these complaints that the League has transferred to the public prosecutor’s office, in ten of them Vinícius has been the victim of racist insults. Iñaki and Nico Williams, Carlos Akapo and Samu Chukwueze have also been injured. Of all these cases, five of them are still being investigated, in four proceedings have already been opened against those responsible and another four were archived by the Prosecutor’s Office, despite the fact that the racist insults were proven.

The first case filed corresponds to the insults that Vinícius received at the Camp Nou during a classic held in 2020. The Prosecutor’s Office closed the case “since the identification of the perpetrators of the events was not achieved” by the police authorities. In another subsequent case, in Mallorca in 2022, the Prosecutor’s Office argued to shelve the case that “the expression and sounds made, undoubtedly typical of profane and despicable attitudes, as well as vexatious and absolutely rejectable, do not initially seem to have , for the present case, the public penal dimension that is postulated”.

The case for racism against Nico Williams at the Benito Villamarín in March of last year was also dismissed. “Despite not having declared, the study of the defendant’s social networks seems to show that he is not a person who intends to incite racism,” said the Prosecutor’s Office at the time, and, therefore, “despite their incorrectness, ( insults) do not cross the line of the criminal offence”.

Finally, the case for the racist shouting in September 2022 against Vinicíus by dozens of followers in the Metropolitan was also filed because there was no “a specific act to impute to a specific person and, once the insults of a racist nature were contextualized, neither they would constitute a crime against the dignity of the person […] since they were spilled on the occasion of the celebration of a soccer match of maximum rivalry, together with the fact that they lasted a few seconds”, argued the Prosecutor’s Office at the time.
