Facua-Consumers in Action has denounced the promoter of the Boombastic Festival, which was held this weekend at the Miguel Ríos Auditorium in the Rivas-Vaciamadrid municipality, for not allowing foreign food and drinks to enter the venue.
The organization has stated that it will take the same measures in the rest of the locations in the country where this event is held (Asturias, Valencia and Andalusia) to safeguard the interests of the attendees.
The prohibition of the entry of food and drink is indicated in the questions and answers section of the festival website, and it reads as follows: “it is only possible to access with a bottle of water of maximum 50 centilitres, without a cap, for own consumption Within the enclosure you will find all kinds of food trucks and drink stalls to enjoy the festival to the fullest”.
The association has warned that, in the event that a rectification is not produced, they could incur in a consumer infraction, since it is an abusive clause.
The agency points out that the attendees of the event have the right to introduce drinks and food from abroad because the main activity of the promoter of the Boombastic Festival is not the hotel business, but the production and execution of leisure and recreation activities. “This prohibition for access to the venue is not necessary for the correct achievement of the commercialized activity,” they insist.
Facua has also referred to the report prepared in 2016 by the Spanish Agency for Food Safety and Nutrition (Aesan), which considered this same prohibition in cinemas “an abusive clause”.
Specifically, it was considered that the consumer was “unjustifiably deprived of the main service, having paid for the ticket, based on a limitation imposed unilaterally with respect to an accessory service that he has not requested, and taking into account that the activity business is not the sale and distribution of food and drink”.
For this reason, those attending this and other festivals who encounter limitations of this type are invited to come to the association “to assess the filing of complaints and claims and defend their rights and interests as consumers and users”.
