The Provincial Court of Murcia has dismissed the appeal presented by a woman against the sentence of a Criminal Court of Cartagena that sentenced her to seven months in prison and a fine of 720 euros as the author of a crime of perjury, committed by lying in the trial to protect his abuser.

He points out the ruling of the Court, to which EFE has had access, which the court declared proven that the defendant came in February 2021 to testify as a victim of a crime of gender violence in the trial against her husband in another court in the City Penitentiary.

As is mandatory, she was told that she was summoned as a witness and could avail herself of her right not to testify, but that if she decided to do so, she must tell the truth, otherwise she could incur a crime of perjury.

Despite this warning, the defendant assured, contrary to the truth, that the injuries she suffered had not been caused by her husband, but were the result of the fact that, after arguing with him, she tripped and injured her leg when she fell. .

The sentence stated that the defendant denied at all times that the injuries had been caused by the defendant, “knowing that this was not true and in clear contradiction with the rest of the proceedings.”

The court ruling also stated that the National Police officers who went to the house where the events took place observed that her face was bloody and numb, and one eye was swollen, telling them the neighbors who were assisting her and the victim herself that the perpetrator of injuries was his partner.

The agents declared at the oral hearing that at first, when he was arrested, the husband admitted to having hit her in the face, while the forensic medical report stated that the defendant confessed to them that the injuries had been caused by assault and punches. and the subsequent fall to the ground.
