The prosecutor asks for 24 years in prison for the person accused of killing a young man with knives in a house in Masarac (Alt Empordà) on August 31, 2022.

The Prosecutor’s Office accuses him of a crime of murder and points out that the attack was treasonous and that the victim had no chance to defend himself.

In the brief with provisional conclusions, the prosecutor states that the two young people shared a room in the house where seasonal workers of sub-Saharan origin were staying. They had had an argument over domestic disputes and had agreed to “fight.” Hours before the victim came home, the defendant took a knife and hid it under the bedding. Around eight in the evening, and when the victim returned, he attacked him “unexpectedly and by surprise.”

According to the indictment of prosecutor Víctor Pillado, the defendant planned the crime and five hours before the events, around three in the afternoon, took a “large” knife and hid it under the bedding in the place where slept. He shared a room with the victim, a 29-year-old man of Gambian origin.

The two young people had met to “fight” as a result of a discussion they had had the day before due to a coexistence problem. The prosecutor maintains that the victim was not at home, located at number 9 Mont Street, when the defendant hid the knife and that, therefore, he could not know that the other young man, also of Gambian origin and 26 years old at the time of the facts, he was armed: “The defendant hid the knife to have a bladed weapon to use during the agreed fight.”

The victim returned home around eight in the afternoon on August 31 and went to the room she shared with the defendant. There, “unexpectedly and by surprise”, the defendant took the knife out of the bedding and attacked the other young man. According to the prosecutor, he did it knowing that the victim was “totally unarmed” and when he had him “cornered” in a corner of the room and without any way to escape.

The defendant dealt him a first stab in the left subclavicular region that ended up perforating the upper lobe of the lung. According to the public accusation, without fully extracting the knife from the body and being aware of the victim’s “zero defense capacity”, he withdrew the knife a little and stabbed him again, affecting various vascular structures.

The indictment states that the victim died “immediately” from hypovolemic shock as a result of the stab wounds.

As reported at the time of the events, other men who lived in the house alerted a neighbor, who was the one who ended up calling the emergency services. The Mossos d’Esquadra arrested the alleged murderer the same day in Masarac. The suspect was handed over to the investigative court 6 of Figueres on September 3 and the magistrate ordered prison without bail.

Prosecutor Víctor Pillado requests 24 years in prison for the defendant as the alleged perpetrator of a crime of murder. He also requests that, in case of conviction, he be expelled from the country with an entry ban for 10 years once he reaches the third grade or when he is granted parole.

As regards civil liability, he wants him to compensate the victim’s relatives (mother and five siblings) with a total of 340,000 euros for moral damage.

It is expected that the case, which will be judged by a people’s court, will come to trial shortly at the Girona Court.
