It was the youngest, a 3-year-old boy, who was screaming for help from the window of his house when the storm woke him up on September 14 and he realized that he was alone in the house. The alarmed neighbors called the Civil Guard of Alhaurín de la Torre, in Málaga, whose agents took charge of the case and placed the boy in temporary foster care.

The mother had gone out with her partner, leaving the child at home and, upon returning, she learned that La Benemérita had taken him. It was then that she went to the barracks, where she was accused of an alleged crime of abandonment, although on this occasion, although the case was still being investigated, she was released. However, a day later she entered prison due to the execution of a sentence handed down by the Criminal Court number 5 of Malaga in which she was convicted of the crime of attacking law enforcement officers, three minor crimes of injury and one crime of damage, all of them for events that occurred in 2018.

This was reported this Monday by the Superior Court of Justice of Andalusia (TSJA), who clarified that, in relation to the alleged commission of a crime of family abandonment, the Investigative Court number 13 of Malaga agreed last Friday, 15 September, his provisional release, although it remains under investigation.

Regarding these facts, the sentence handed down in November 2019 declares it proven that, on the night of August 20, 2018 in Alhaurín de la Torre, agents of the authority asked the woman for her identification due to her alleged involvement in a brawl. , showing a document from another person, for which she was taken to police stations.

Once there, they verified that there was a search and arrest warrant for the accused, so they proceeded to arrest her. At this moment, she modified her behavior, appearing “very aggressive, out of her mind”, beginning to spit at the agents, rebuking them with phrases such as “Sons of bitches, faggots, you’re here for 1,500 euros, you’re all dead, I’m leaving.” to ensure that they finish you off”, giving various kicks, punches and blows to agents of the authority of the Civil Guard and the Local Police, causing them injuries of varying degrees.

The accused was then put into a police vehicle, kicking the windows and causing damage that has been budgeted at 460.04 euros, as was proven in the sentence.

These events were classified as constituting a crime of attack on law enforcement officials, for which she was sentenced to one year and six months in prison, in addition to three minor crimes of injury and one minor crime of damage, with a penalty for each. of them a two-month fine at a daily rate of six euros.

The accused also had to compensate the General Directorate of the Civil Guard in the amount of 460.04 euros for the damage caused to the police vehicle, in addition to the Civil Guard agent in the amount of 270 euros and the local police officers, with 210 euros each.

The accused did not appear at the oral trial nor provide evidence that would allow the injured party’s version to be refuted.
